Two questions:
1. Does C&F investigators get copies of all resumes you have sent out?
2. If there is an academic issue from a long time ago, that the professor/school sealed it and promised not to disclose and it is not on a transcript either, does one still need to disclose it?

It is important to be completely candid with the C&F committee.  If you are not sure what to include or not, call them and discuss the issue directly with them.  There are cases of applicants passing the Bar and not being sworn in due to C&F issues.

I think what people forget is that the committee may not disqualify you for what you did in the past - but more for not DISCLOSING what you did.

If you have some concern that they may find something, I lean on the side of disclosing it and write an explanation as to what were the reasons behind it. It's better than being uneasy as to what they might and might not discover in your past.

Makes me kinda of worried of what you are putting on your resume if your afraid of the bar examiners getting a hold of it.  Are you putting something down that they don't know about or you putting something down that is not true.
If you don't disclose it and they find out about it then you will be in more trouble then if your up front about.  They can/may and have done in the past not granting you a license.

To answer your first question with a question, why in the world would you ask such a question.

To answer it with an answer, they get copies of anything that anybody wishes to send them. So, if a former employer sees something on your resume and wishes them to know about it, then she/he can definitely send a copy for them to investigate as it relates to C&F.

That said, it probably does not matter if you lied to a former employer, just don't lie to the C&F committee.

Actually I don't think they are able to use what is not requested. If a third party who wasn't requested to send information sends information, it cannot be used.

A part of the references check includes the question whether there are people your references know who would have information relevant to your C&F application. So your references are able to refer to the Committee people who know you and who can then submit information about you that you never consented to yourself. Better policy is to just be candid about your past and answer all questions truthfully and completely.
