  • Essie i have a question about "burglary." I was doing a MBE practice question in one of the PMBR books and the answer says that under modern construction, for a "breaking and entering" to occur, it is required only that the defendant make a trespassory entry onto the premises. Is that true? So, if the question states that the defendant reaches in a window of a dwelling at night that has already been cracked open to steal something, is that considered as burglary? The actual movement of opening the window is no longer needed? BarBri, though, says that you would actually have to "break something," even if it's to crack upon the I'm so confused. HELP!
